Collection of Your Information

Our access and/or collection of Your Information depends on how You use Our Services. We have set out below the Information which We may access, collect, handle, transfer, transmit, store, use, deal with and/or disclose.

  1. We may process information contained in any enquiry You submit to Us regarding Our Services (" enquiry data "). The enquiry data may be processed for the purposes of offering, marketing and selling relevant Services to You, and to allow You to participate in interactive features of Our Services, if you choose to do so.

Account data may include without limitation, Your name, job title, business email address, Your preferences, business phone number, User Details, and the name of Your employer. The source of the account data is You or your employer, or information publicly available on Your Bloomberg profile or other such service. The account data may be processed for the purposes of operating the Site, providing Our Services, ensuring the security of our Site and Services, maintaining back-ups of our databases, and communicating with You. The legal basis for this processing is Our legitimate business interests, namely the proper administration of Our Site and business, and the performance of a contract between You/Your employer and Us, and/or taking steps to enter into such a contract.
  5. We may process information relating to Our customer relationships, including customer contact information ("customer relationship data"). The customer relationship data may include Your name, job title, business email address, business phone number, the name of Your employer, and information contained in communications between Us and You/Your employer. The source of the customer relationship data is You or Your employer. The customer relationship data may be processed for the purposes of managing Our relationships with customers, communicating with customers, keeping records of those communications, and promoting Our Services to customers.
  6. We may process the information that is provided in the course of the use of Our Services (" service data "). This service data may include the portfolios You created and/or uploaded on the Site, financial data, name, job title, business email address, business phone number, and the name of Your employer. The source of the service data is You or Your employer. The service data may be processed for the purposes of operating Our Site, providing You with information, Services that You request from Us or which We feel may interest You, carrying out Our obligations arising from any contracts entered into between You/Your employer and Us, ensuring the security of Our Site and Services, maintaining back-ups of Our databases and communicating with You.
  7. We may process information that you provide to Us for the purpose of subscribing to our email notifications ("notification data"). The notification data may be processed for the purpose of sending You relevant notifications regarding Our Services.
  8. We may process information contained in, or relating to, any communication that You send to Us ("correspondence data"). The correspondence data may include the communication content and metadata associated with the communication. Our Site will generate the metadata associated with communications made using the Site contact forms or directed at email addresses in Our domain. The correspondence data may be processed for the purposes of communicating with you, record-keeping and reporting.

We may process information that You provide by filling in applications, forms or questionnaires or agreements You or Your employer enter into with Us or in the course of Your establishing or maintaining a customer relationship with Us. You have the right to instruct Lucror at any time not to use Your Information covered by this Privacy Policy to provide You with offers and promotions by writing to Us at the address mentioned in Section 13. If You exercise such choice, You will continue to receive communications concerning Your subscription and Services You requested. Note, that the process for opting-out may take time to process.

Providing Your Information to others

  1. We store Your Information in Singapore and the United States of America. The hosting facilities for Our Site are situated in the United States of America. We have set out below information about the circumstances in which Your Information may be transferred to countries other than Singapore and the United States of America. Such transfers are necessary to provide the Services set forth in theTerms of Use and to globally operate and provide Our Services. We may disclose Your Information to any member of Our group of companies (this means our subsidiaries, affiliates, our ultimate holding company and all its subsidiaries), including their respective employees, directors, officers, consultants, contractors, agents, and/or representatives and to each of Our respective employees, directors, officers, consultants, contractors, agents, and/or representatives, insofar as reasonably necessary for the purposes and on the legal bases, set out in this Privacy Policy.

We may disclose Your Information to Our insurers and/or professional advisers insofar as reasonably necessary for the purposes of obtaining or maintaining insurance coverage, managing risks, obtaining professional advice, or the establishment, exercise or defence of legal claims, whether in court proceedings or in an administrative or out-of-court procedure.
  3. We may disclose Your Information to Our suppliers or subcontractors insofar as reasonably necessary for the purposes of operating Our Site, providing Our Services, ensuring the security of Our Site and Services, maintaining back-ups of our databases, and communicating with You.

We may transfer Your information, to third parties if We are under a duty to disclose or share such information in order to comply with any legal obligation, or where We believe in good faith that the law requires it, or at the request of Governmental authorities conducting an investigation or in order to enforce, verify or apply Our Terms of Use and other agreements or policies, or to protect Our rights, property, or safety and the rights, property or safety of Our users, customers or others or to respond to an emergency. Such disclosure may be carried out with or without notice to You.

International transfers of Your Information

  1. We have set out below information about the circumstances in which Your Information may be transferred to countries other than Singapore and the United States of America. Such transfers are necessary to provide the Services set forth in theTerms of Use and to globally operate and provide Our Services.
  2. Lucror has offices and/or facilities in Singapore, the European Union, and the United States of America. The European Commission has made an "adequacy decision" with respect to the data protection laws of the European Union and the United States of America (limited to the Privacy Shield framework). Transfers to the European Union and the United States of America will be protected by appropriate safeguards, namely the use of standard data protection clauses adopted or approved by the European Commission, a copy of which can be obtained from the Website of the European commission. If You are located in other regions with laws governing data collection and use that may differ from Singapore law and laws of the United States of America, please note that We may transfer Your Information, including Your personal and sensitive information, to a country and jurisdiction that does not have the same data-protection laws as Your jurisdiction.
  3. The European Commission has made an "adequacy decision" with respect to the data protection laws of the United States (limited to the Privacy Shield framework). Retaining and deleting Your Information

  1. This Section 6 sets out Our data retention policies and procedure, which are designed to help ensure that We comply with Our legal obligations in relation to the retention and deletion of Your Information.
  2. Your Information that We process for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes.
  3. You Information in relation to the provision of Our services will be retained for a minimum period of five years following the creation of records in Our systems containing said data, and for a maximum period of ten years or until it is reasonable to assume that the purpose for which that Your Information was collected is no longer being served by retention of Your Information and retention is no longer necessary for legal or business purposes.
  4. In some cases, it is not possible for Us to specify in advance the periods for which Your Information will be retained. In such cases, We will determine the period of retention based on whether it is reasonable to assume that the purpose for which Your Information was collected is still being served by retention of Your Information and whether retention is still necessary for legal or business purposes.

Notwithstanding the other provisions of this Section 6, We may retain Your Information for an extended period when it is the subject of a legal request or obligation, governmental investigation or investigations of possible violations of our terms or policies, or otherwise to prevent harm to any person, including You. We also retain information from accounts disabled for term breaches for at least a year to prevent repeat abuse or other term breaches.
  6. Our Site may contain links to Websites of Our affiliates or of other unaffiliated third parties for Your convenience and information. If You access a link to any of these websites, please note that these Websites have their own privacy policies and that We do not accept any responsibility or liability in relation to Your access or use of such third party Websites. Amendments

  1. We reserve the right, at Our sole discretion, to change, modify, add or remove any or all portions of these Privacy Policy, at any time without any prior written notice to You and such revisions shall be binding on You. Some of the provisions contained in the Privacy Policy may also be superseded by provisions or notices published elsewhere on the Site. It is Your responsibility to review the Privacy Policy and the Site periodically for updates / changes. Your continued use of the Site following the posting of changes will mean that You accept and agree to the revisions.
  2. Without prejudice to the foregoing right under provision 7.1 above, We may choose to notify You of significant changes to this Privacy Policy by email on Your registered email ID or through the notification system on the Site.

Your rights

When We process Your Information, We do so with Your consent and/or as necessary to provide the Site and Services that You use, operate Our business, meet Our contractual and legal obligations, protect the security of our systems and Our customers, or fulfil other legitimate interests of Lucror, as described in this Privacy Policy. In this Section 8, We have summarised the key rights that You have under data protection law. Some of the rights are complex, and not all of the details have been included in Our summaries under this Privacy Policy. Accordingly, You should read the relevant laws and guidance from the regulatory authorities for a full explanation of these rights.

Provided that the rights and freedoms of others are not affected, We will supply to You a copy of Your Information. The first copy will be provided free of charge, but additional copies may be subject to a reasonable fee. Where We are legally permitted to do so, We may refuse Your request of access to Your Information. If We refuse Your request, We will tell you the reasons why.

With respect to any disputes or claims, You agree to submit to the Singapore courts which shall have exclusive jurisdiction with respect to any legal proceedings that may arise from, in connection with or related to the use of the Site and the Service or from a dispute as to the interpretation or breach of the Privacy Policy.
